¶ 1. Who this agreement is between

This agreement is made between you and O.C.P.D PROPERTIES LTD only, not with Apple Inc. We, not Apple, are solely responsible for the app and what it does.

¶ 2. What you may do

We give you a personal, non-exclusive, non-transferable licence to install and use the app on Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Where those rules allow, other accounts in your Family Sharing group or volume purchase programme may use the app as well.

¶ 3. What you may not do

Unless the law gives you the right regardless of this agreement, you may not copy, change, decompile or reverse-engineer the app, try to extract its source code, rent, lend, sell or sublicense it, remove its notices, or use it to build a competing product.

¶ 4. Parts made by others

The app contains open-source software, including WireGuard components. Each of those parts is licensed under its own terms, which apply to that part ahead of this agreement.

¶ 5. Data

To build and keep the VPN tunnel, the app exchanges technical data with our servers: public keys, a random device number, versions and connection reports. The Privacy Policy describes this in full, and by using the app you agree that we may handle data as it describes.

¶ 6. Updates

We may release updates that fix problems, add features or keep the app working with our servers; an older version may stop being able to connect. Updates are covered by this agreement unless they come with their own terms.

¶ 7. Help and maintenance

We alone are responsible for maintaining the app and supporting it, as described on our Support page and as required by law. Apple has no obligation at all to provide maintenance or support for the app.

¶ 8. Warranty

If the app fails to conform to a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price you paid for it, if any; the app is free today, so there is currently nothing to refund. To the maximum extent the law permits, Apple has no other warranty obligation regarding the app. Any other claims, losses, liabilities, damages, costs or expenses caused by such a failure are our responsibility, within the limits of ¶ 13. Beyond what the law requires, the app is provided “as is”.

¶ 9. Claims about the app

We, not Apple, are responsible for dealing with any claim by you or anyone else relating to the app or to having or using it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

¶ 10. If someone says the app infringes their rights

If a third party claims that the app, or your having or using it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

¶ 11. Sanctions and export rules

You confirm that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.

¶ 12. When the licence ends

The licence lasts until you or we end it. It ends automatically if you break this agreement. When it ends, stop using the app and delete it from your devices.

¶ 13. Limits on liability

As far as the law allows, we are not liable for indirect, incidental or consequential damage arising from the app, and our total liability is limited to the amount you paid for the app. Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, or where the law forbids a limit.

¶ 14. Other people’s terms

When you use the app, you must also follow the terms of third parties that apply to you, such as your agreement with your mobile carrier or internet provider.

¶ 15. Apple’s right to enforce

Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right, and will be deemed to have accepted the right, to enforce it against you as a third-party beneficiary.

¶ 16. Governing law

This agreement is governed by the law of the place where O.C.P.D PROPERTIES LTD is incorporated, without taking away any mandatory consumer protection you have in the country where you live.

¶ 17. Questions and complaints

Developer: O.C.P.D PROPERTIES LTD. Send questions, complaints or claims about the app to support [at] ocpd-properties.com.
